MY CLUB - RULES OF PLAY

1)      Participation.
To participate in the MY CLUB program, visit www.1043myfm.com and sign up as a member. Limit one account per person.  If already registered, as a MY CLUB member, you can earn credits/points by visiting the 104.3 MY fm website, logging on to the MY CLUB site and doing any of the following:

a.      Look for the daily Bonus Code, posted each weekday at
www.1043myfm.com.  The code will be posted starting at 12:01am and is valid that day until 11:59pm. Any other passwords, bonus codes, or instant wins will be announced on-air and posted on website with details on how to play.
 
b.      Play other games. At various times during the day, other MY CLUB Codes, words, or names may be announced or posted on the site. These must also be entered online before a designated time that will be posted on the site or announced on-air.
 
c.      Listen to 104.3 MY fm and log on to www.1043myfm.com for dates and locations of 104.3 MY fm events where members can pick up MY CLUB Bonus Codes.
 
d.      MY CLUB credits/points may also be earned in a variety of other ways, at the discretion of 104.3 MY fm. Members can tune into 104.3 MY fm for details on additional ways to accumulate entries/points, or log on to you’re MY CLUB account http://www.1043myfm.com. 104.3 MY fm reserves the right to alter the ways of earning entries/points at its discretion.
 
To become and remain a registered MY CLUB member, you must have Internet access and a valid e-mail account. 104.3 MY fm is not responsible for a member’s inability to: connect to the Internet, log on to the MY CLUB website, gain access to their MY CLUB account or participate in any activity associated with this program, service outages or delays, computer difficulties or other technological glitches. The MY CLUB program is free and no purchase is necessary.

2)    Eligibility

Participation in the MY CLUB program is open to all legal residents of Southern California within the Total Terrestrial Service Area (Los Angeles, Orange, Riverside, Ventura, and San Bernardino Counties) who are 18 years of age or older, that possess a current and valid social security card. Those specifically not eligible are full or part-time employees of Clear Channel Broadcasting (including former employees and their next of kin), other Southern California radio station employees and their immediate families, M2O Media, and sponsors featured in the Program.
a. Participation is expressly limited to one account per person, two accounts per household. Points/Entries are non-transferable and may not be earned in advance. All duplicate accounts or suspected duplicate accounts are subject to cancellation without notification by 104.3 MY fm.  E-mail addresses may not be shared between players; therefore, each account needs to have a unique, valid e-mail address associated with it.


b. Accounts which have an excessive number of rejected e-mails may be automatically locked, preventing the player from accessing the MY CLUB program until they contact MY CLUB Tech Support and provide an alternate e-mail address. Repeated problems with e-mail delivery to a player may result in permanent suspension of the member's account.

c. Members are not authorized to access any other member’s account for any reason, including but not limited to entering codes or redeeming MY CLUB entries/points for prizes or awards, even if the other member is a family member. Members must personally enter codes and play the various MY CLUB games and surveys themselves to legally accumulate points/entries.
 
d. No machines, scripts or automated services may be used to access any part of the MY CLUB website, accumulate any points/entries, bid on prizes and awards, or in any other way participate in this program. Any attempt to saturate the MY CLUB system's resources by making continuous automated requests to the system is not permitted, and is grounds for account suspension or termination at the sole discretion of 104.3 MY fm.
 
e. 104.3 MY fm is NOT responsible for members missing out on points/entries due to, but not limited to, the following: forgotten username and/or password; problems, updates or maintenance which affects the MY CLUB program at a particular time, Internet, browser, server, or computer problems in general, lost codes, bonus codes or coupons, forgotten, incorrectly entered or misspelled codes, etc.
 
f. Redemption of any points/entries suspected to have been made in such a fashion so as to not deduct the appropriate balance, may be disqualified (not accepted), at the sole discretion of 104.3 MY fm.
 
g. The authorized account holder or member is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
 
h. 104.3 MY fm reserves the right to disqualify any member from receiving a cash award or prize award where 104.3 MY fm, at its sole discretion, determines that the member has violated any of these rules, made any misrepresentation in connection with this program, or used any unintended/unannounced means to accumulate or redeem MY CLUB points/entries.

i. Posting or sharing of MY CLUB Codes, Bonus Codes, or other MY CLUB points/entries earned among members is expressly prohibited. Violations will result in the termination of all violating account(s) and/or forfeiture of all accumulated points/entries with no compensation of any kind.
 
j. 104.3 MY fm reserves the right to use any listener feedback in any way they choose. 
 
3)       Prize Awards
 
Each item on MY STORE, MY TICKET, AND MY AUCTION prize pages will be assigned a point/entry value. Members may redeem accumulated MY CLUB points/entries for free prizes and awards.
 
a.      All prizes must be picked up at the office of 104.3 MY fm located at 3400 Olive Ave., Suite 550, Burbank CA 91505 unless otherwise specified upon point/entries redemption.
 
b.      Station hours are 9:30am to 4:30pm, Monday through Friday (except holidays). When picking up your prize, you must provide a valid California Driver’s license or a government issued ID card and your prize confirmation print out. In addition, you must fill out a station provided W9 tax form before your prize will be awarded.
 
c.      If a winner is unable to personally pick up a prize, said winner can assign a proxy to do so by sending a clear readable copy of their California Drivers License or government issued ID card, an original and complete W9 tax form (provided to the winner in advance by the station) along with a signed and detailed letter of release authorizing a “specific person” to pick up a “specific prize.” All signatures on these documents must clearly match the signature on the government issued ID. Furthermore, the proxy must provide proof of their identity (in the form of a valid California Drivers License or a government issued ID card) as identified in the release letter provided by the winner.  If any of the proxy documents provided are suspect for any reason, Clear Channel retains the right to delay release/delivery of the prize until the documents provided can be verified.
 
If acting as proxy for other Rewards Program members, you may only pick up prizes for up to 3 people TOTAL per day.
 
d.      Prizes must be picked up within 30 days of purchase - unless otherwise specified. Prizes not picked up within 30 days from the date of purchase will be forfeited and points/entries will not be refunded.
 
e.      Mailing options are at the sole discretion of 104.3 MY fm and will only be considered in extreme circumstances, or will be based on the prize size, weight, timeliness and value. Prizes valued at over $20, time-sensitive prizes, tickets and gift certificates must be picked up. Member is always responsible to keep his/her MY CLUB account up-to-date with current information. If 104.3 MY fm deems that an individual has extreme circumstances and a prize is mailed out, 104.3 MY fm is not responsible if it is lost, stolen, misdirected, or damaged. The prize will not be replaced with future prizes nor will points/entries be refunded.
 
f.        Prize winners are responsible for any and all expenses associated with their travel to and from the 104.3 MY fm offices or other any location(s) associated with claiming a prize or award.
 
g.      MY CLUB points/entries will not be credited or refunded for any reward, item or certificate which a Member claims but does not subsequently use.
 
h.      Member agrees to provide only true and accurate information to the MY CLUB Program at all times. In conjunction with claiming any item associated with the MY CLUB Program or spending any points/entries for items, Member agrees to verify that all information in their MY CLUB account profile is up-to-date and accurate by providing a valid California driver's license or government issued photo ID that matches the information in their profile. Furthermore, regular profile updates are strongly encouraged.
 
i.        MY CLUB award items are not transferable. Awards may not be substituted for cash or any other items or merchandise.
 
j.        All award claims are subject to verification by 104.3 MY fm Management. All decisions made by 104.3 MY fm Management are final.
 
k.      Prizes and awards will be awarded and distributed at the discretion of 104.3 MY fm.
 

4)   Taxes
     
Any valuation of the prize(s) stated above is based on available information provided to The Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which is not specifically provided for in the official rules. Each winner must provide The Company with valid government issued California identification and a valid taxpayer identification number and social security number before any prize will be awarded. Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. If the prize includes travel, lodging, entertainment, or a special event, winner is responsible for all taxes, expenses, and gratuities not expressly included in and as part of the prize. Winner agrees to accept all blackout dates, space availability requirements, etc. established by The Company’s prize partner(s), such as hotels, airlines, trains, ships, etc. Winner agrees that acceptance of any trip taken as a prize from The Company does so entirely upon their own initiative, risk, and responsibility. If the trip requires traveling outside of the United States, the winner, upon winning the prize, must have a valid US passport. If the winner does not have a valid US passport upon winning the prize, the trip may be forfeited
 

5)   How to Redeem Points / Entries to Receive Prizes


A validated MY CLUB Member redeems MY CLUB points/entries by clicking on the "Submit" button for Awards, or for Raffle entries on the MY CLUB website. In the event that another member is already in the process of redeeming that particular prize/item, the member who "first" clicked on "Submit" will receive the item/prize.
 
In order to receive a prize or reward, winning members must contact 104.3 MY fm in accordance with instructions provided as part of this program, or provided online in connection with a specific offering, AND comply with the instructions provided by 104.3 MY fm  personnel for verification and deduction of points/entries balance.
 
Failure to comply with the instructions may result in disqualification, at the sole discretion of 104.3 MY fm. Any member that has a "winning" bid, and then fails to demonstrate they have the needed points/entries in their account following an audit, will not be entitled to receive the award/prize and, at the discretion of 104.3 MY fm, will have their points/entries balance forfeited.
 
Member points/entry totals are subject to adjustment, and member accounts are subject to suspension or cancellation, by 104.3 MY fm for any activity which is in violation of any rules, or which is not in compliance with the intent of the program. 104.3 MY fm shall be the sole determiner in cases of suspected abuse or violation of MY CLUB rules, and any decision it makes relating to adjustment of points/entries or termination of membership shall be final and binding. Members will be notified of any such adjustments through a posting in the history log (viewable in the Transactions section of My Account in the MY CLUB Program or through an e-mail sent to the e-mail address in the member's account profile.) Should the member disagree with any points/entries adjustment or account suspension, the sole remedy will be withdrawal from the program.
 
104.3 MY fm makes no representations whatsoever regarding the value, if any, of points/entries earned as a result of participation. 104.3 MY fm is under no obligation to provide members with any particular number of points/entry-earning opportunities or rewards.
 

6)   Conditions


The act of participation in the MY CLUB program by Members, winners and qualifiers constitutes permission to the 104.3 MY fm sponsor, and its agencies to use the member’s name and/or likeness for the purposes of advertising and trade without further compensation.
 
a.      Members may be required to sign a liability release prior to acceptance of an item. Pursuant to the liability release, Member will agree to hold M2O Media, Clear Channel Communications, 104.3 MY fm, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the MY CLUB Program.
 
b.      104.3 MY fm, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the 104.3 MY fm websites, or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the MY CLUB program if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
 
c.      104.3 MY fm reserves the right to make changes to the official MY CLUB program rules at any time without warning. Notification of any revisions and their immediate effectiveness will be permanently posted to this page and to your personal messages on your log in page for one week. You are encouraged to revisit this page from time to time to ensure that you are aware of any and all rules. It is the individual player’s responsibility to know and understand the content of the official rules at all time. By using the MY CLUB Program and participating in the contests herein, you are indicating your understanding and acceptance of all official rules.
 
d.      104.3 MY fm  reserves the right to substitute an item of equivalent or greater value should an original item awarded and/or purchased by a player become unavailable. Point/Entry values associated with any award can be changed or modified at any time. All Awards offered will show quantity available and will be redeemed on a first-come, first-served basis. 104.3 MY fm reserves the right to limit the quantity a member can buy of any specific Award.
 
e.      104.3 MY fm reserves the right to disqualify any member from receiving a cash or prize award, where 104.3 MY fm , at its sole discretion, determines that the player has misrepresented or used unintended/unannounced means to accumulate points/entries to purchase prizes.
 
f.        Members may be asked to supply personal information. This information will not be sold to outsiders, but the aggregate information (without identifying players as individuals) will be used for marketing purposes by 104.3 MY fm and its affiliates.
 
g.      104.3 MY fm reserves the right to discontinue, suspend or modify this Program at any time, including the termination of all opportunities to use or otherwise redeem accumulated MY CLUB points/entries. From time to time 104.3 MY fm may decrease or zero out the points in all MY CLUB accounts. At those times all accounts will either start at zero points or be decreased by an amount or percentage to be determined by 104.3 MY fm and all unused points/entries will no longer be valid. Members will be notified if and when the points/entry deduction will take place.
 
h.      No purchase is necessary. The MY CLUB program is void where prohibited.
 
i.        Failure to comply with the MY CLUB program rules may result in a player's disqualification at the sole discretion of 104.3 MY fm.
 
j.        A written copy of the MY CLUB rules is available during regular business hours at the 104.3 MY fm offices or by sending a self-addressed stamped envelope to:
