TERMS AND CONDITIONS AND CONTEST RULES By signing up 96.7 CHYM FM Platinum VIP agree to abide by the terms and conditions and contest rules set out herein, which may be amended from time to time, and failure to do so may result in forfeiture of Points and cancellation of 96.7 CHYM FM Platinum VIP membership. 96.7 CHYM FM Platinum V.I.P Please note that these rules were updated as of November 29, 2006 to clearly define the geographic area you are required to live in in order to participate in this program. (see Eligibility below) 96.7 CHYM FM Platinum V.I.P Rules
1. Participation
To participate in 96.7 CHYM FM Platinum VIP program visit http://www.chymfm.com/ and sign up to become a member. 96.7 CHYM FM Platinum VIP is for personal use only; businesses, corporations, joint ventures, partnerships, groups or associations are not eligible. Limit one user account per person. Once signed up as a 96.7CHYM FM Platinum VIP you can earn Points by listening to 96.7 CHYM FM and visiting http://www.chymfm.com/ to log on to 96.7 CHYM FM Platinum VIP and doing any of the following:
1a. Rewards Songs of the Day:
Listen to 96.7 CHYM FM, Monday through Friday at 8am, noon, 4pm & 7pm, for the Rewards Songs of the Day. Access to the 96.7 CHYM FM Platinum VIP is through the home page of 96.7 CHYM FM located at http://www.chymfm.com/
Visit 96.7 CHYM FM Platinum VIP at http://www.chymfm.com/, login to 96.7 CHYM FM Platinum VIP – go to “Earn Points” and click on Rewards Songs of the Day. Pick the correct song as announced on 96.7 CHYM FM , then click Submit. Once you click the Submit button, you will not be allowed to make another entry.
2. Gift Card Codes, Instant Win Codes:
Listen to 96.7 CHYM FM for random announcements of Bonus Codes. Bonus Codes may also be posted on the website or distributed through “CHYMLINE” (a newsletter designed and sent exclusively to the members of 96.7 CHYM FM Platinum VIP).
5. Other Contest Plays or Opportunities:
At various times during the day, other 96.7 CHYM FM Bonus Codes (numbers, words, or names) may be announced or posted on the site. These must also be entered on line before a designated time. This designated time will be posted on the site or announced on-air.
6. 96.7 CHYM FM Events:
Listen to 96.7 CHYM FM and logon to http://www.chymfm.com/ for dates and locations of 96.7 CHYM FM events where members can pick up 96.7 CHYM FM Platinum VIP Bonus Codes.
7. 96.7 CHYM FM Platinum VIP Points may also be earned in a variety of other ways, at the discretion of 96.7 CHYM FM. Members can tune into 96.7 CHYM FM for details on additional ways to accumulate Points, or logon to 96.7 CHYM FM Platinum VIP at http://www.chymfm.com/. 96.7 CHYM FM reserves the right to alter the ways of earning Points at its discretion.
To become and remain a registered 96.7 CHYM FM Platinum VIP, you must have Internet access and a valid email account. 96.7 CHYM FM is not responsible for a member's inability to: connect to the Internet, login to the 96.7 CHYM FM Platinum VIP website, gain access to their 96.7 CHYM FM Platinum VIP account or participate in any activity associated with this program, service outages or delays, computer difficulties or other technological glitches. 96.7 CHYM FM Platinum VIP membership is free and no purchase is necessary.
2. Eligibility

Participation in 96.7 CHYM FM Platinum V.I.P is open to all residents who reside in the following postal codes: N0A, N0B, N0C, N0E, N0G, N0H, N0J, N0K, N0M, N1C, N1E, N1G, N1H, N1K, N1L, N1M, N1P, N1R, N1S, N1T, N2A, N2B, N2C, N2E, N2G, N2H, N2J, N2K, N2L, N2M, N2N, N2P, N2R, N2T, N2V, N2Z, N3A, N3B, N3C, N3E, N3H, N3L, N3P, N3R, N3S, N3T, N3V, N3W, N3Y, N4B, N4G, N4N, N4S, N4T, N4V, N4W, N4X, N4Z, N5A, N5C, L0R, LOP, L7J, L9T who are 18 years of age or older. Those specifically not eligible are full or part-time employees of 96.7 CHYM FM or Rogers Broadcasting Ltd. (including former employees and their next of kin), other Kitchener-Waterloo or Tri-City area radio station employees and their immediate families, M2O Media, and sponsors featured in the Program.
1. Participation is expressly limited to one account per person. 96.7 CHYM FM Platinum V.I.P Points are non-transferable and may not be earned in advance. All duplicate accounts or suspected duplicate accounts are subject to cancellation without notification by 96.7 CHYM FM.
2. Email addresses may not be shared between players; therefore, each account needs to have a unique, valid email address associated with it.
3. Accounts which have an excessive number of rejected emails may be automatically locked, preventing the player from accessing 96.7 CHYM FM Platinum V.I.P until they contact the 96.7 CHYM FM Platinum V.I.P Tech Support and provide an alternate email address. Repeated problems with email delivery to a player may result in permanent suspension of the member's account.
Members are not authorized to access any other member’s account, including entering codes or redeeming 96.7 CHYM FM Platinum V.I.P Points for prizes or awards, even if the other member is a family member. Members need to enter codes and play the various 96.7 CHYM FM Platinum V.I.P games and surveys themselves to legally accumulate 96.7 CHYM FM Platinum V.I.P Points.
4. No machines, scripts or automated services may be used to access any part of the 96.7 CHYM FM Platinum V.I.P website, accumulate any 96.7 CHYM FM V.I.P Points, bid on prizes and awards, or in any other way participate in this program. Over usage of the 96.7 CHYM FM Platinum V.I.P system resources is not permitted, and are grounds for account suspension or termination at the sole discretion of 96.7 CHYM FM.
5. 96.7 CHYM FM is NOT responsible for members missing out on 96.7 CHYM FM Platinum V.I.P Points due to, but not limited to, the following: forgotten username and/or password; problems, updates or maintenance which affects 96.7 CHYM FM Platinum V.I.P at a particular time; internet, browser, server, or computer problems in general; lost codes or coupons; forgotten, incorrectly entered or misspelled codes, etc.
6. Any 96.7 CHYM FM Platinum V.I.P Points redemption suspected to be an inauthentic copy, or which is made in such a fashion as to not deduct the appropriate 96.7 CHYM FM Platinum V.I.P Points amounts, may be disqualified (not accepted), at the sole discretion of 96.7 CHYM FM.
7. The authorized account holder or member is defined as the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address.
8. 96.7 CHYM FM reserves the right to disqualify any member from receiving a cash or prize award where 96.7 CHYM FM Platinum V.I.P, at its sole discretion, determines that the member has violated any of these rules, made any misrepresentation in connection with this program, or used any unintended/unannounced means to accumulate or redeem 96.7 CHYM FM Platinum V.I.P Points. 7. The authorized account holder or member is defined as the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address.
8. 96.7 CHYM FM reserves the right to disqualify any member from receiving a cash or prize award where 96.7 CHYM FM, at its sole discretion, determines that the member has violated any of these rules, made any misrepresentation in connection with this program, or used any unintended/unannounced means to accumulate or redeem 96.7 CHYM FM Platinum VIP Points.
9. Sharing of Rewards Songs of the Day, Bonus Codes, or other 96.7 CHYM FM Platinum VIP Points earning among members is expressly prohibited. Violations will result in the termination of all violating account(s) and/or forfeiture of all accumulated Points.
10. By becoming a 96.7 CHYM FM Platinum VIP, members consent to the use of any member feedback provided on the website in any and all media without compensation.
3. Prize Awards
Each item on the CHYM FM Store or Enter to Win, pages will be assigned a Point value. Members may redeem accumulated 96.7 CHYM FM Platinum VIP Points for free prizes and awards.
1. All prizes and awards must be picked up at 96.7 CHYM FM located at 305 King Street West, 11th Floor (corner of King & Water), Kitchener, Ontario, N2G 4E4, unless otherwise specified upon Point redemption.
2. 96.7 CHYM FM hours are 8:30AM to 5:30PM, Monday through Friday, (except holidays). When picking up your prize or award, you must provide a photo ID. Prizing will not at any time be released to anyone other than the account holder (winner). Photo ID presented must reflect the information used to activate account (name, address and postal code) Prizes must be picked-up within 30 business days of Point redemption - unless otherwise specified. Prizes and awards not picked up within 30 days from the date of Point redemption will be forfeited and the associated Points will not be refunded.
3. Some prizing (including but not limited to items of a 500 dollar value or more or at the discretion of a 96.7 CHYM FM representative) may need to be picked up during regular business hours at the 96.7 CHYM FM office at 305 King Street West, 11th Floor (corner of King & Water), Kitchener, Ontario, N2G 4E4. Winner is responsible to make arrangements to pick up prize. No prizing will be mailed or sent by courier. Member is always responsible to keep his/her 96.7 CHYM FM Platinum VIP account up-to-date with current information.
4. Prize winners are responsible for any and all expenses associated with their travel to and from 96.7 CHYM FM offices or any other location(s) associated with claiming a prize or award.
5. 96.7 CHYM FM Platinum VIP Points will not be credited or refunded for any reward, item or certificate which a Member claims but does not subsequently use.
6. Member agrees to provide only true and accurate information to 96.7 CHYM FM Platinum VIP at all times. In conjunction with claiming any item associated with the 96.7 CHYM FM Platinum VIP or spending any Points for items, Member agrees to verify that all information in their 96.7 CHYM FM Platinum VIP account profile is up-to-date and accurate by providing a valid driver's license or photo ID that substantially matches the information in their profile.
7. 96.7 CHYM FM Platinum VIP award items are not transferable. Awards may not be substituted for cash or any other items or merchandise.
8. All Award claims are subject to verification by 96.7 CHYM FM management. All decisions made by 96.7 CHYM FM management are final.
9. Prizes and awards will be awarded and distributed at the discretion of 96.7 CHYM FM .
4. How to Redeem Points / Entries to Receive Prizes
A validated 96.7 CHYM FM Platinum VIP redeems 96.7 CHYM FM Platinum VIP Points by clicking on the "Submit" button for 96.7 CHYM Store or for Enter to Win entries on the 96.7 CHYM FM Platinum VIP website. In the event that another member is already in the process of redeeming that particular prize/item, the member who "first" clicked on "Submit" will receive the item/prize. The sole determinant of time for the purposes of determining the first person eligible will be the 96.7 CHYM FM server machine(s).
In order to receive a prize or reward, winning members must contact 96.7 CHYM FM in accordance with instructions provided as part of this program, or provided online in connection with a specific offering, AND comply with the instructions provided by 96.7 CHYM FM personnel for verification and deduction of Points balances.
Failure to comply with the instructions may result in disqualification, at the sole discretion of 96.7 CHYM FM. Any member that has a "winning" bid, and then fails to demonstrate they have the needed 96.7 CHYM FM Platinum VIP Points in their account following an audit, will not be entitled to receive the award or prize and, at the discretion of 96.7 CHYM FM, will have their Points balance forfeited.
Member Points totals are subject to adjustment, and member accounts are subject to suspension or cancellation, by 96.7 CHYM FM for any activity which is in violation of any rules, or which is not in compliance with the intent of the program. 96.7 CHYM FM shall be the sole determiner in cases of suspected abuse or violation of 96.7 CHYM FM Platinum VIP rules, and any decision it makes relating to adjustment of Points or termination of membership shall be final and binding. Members will be notified of any such adjustments through a posting in the history log (viewable in the Transactions section of My Account in 96.7 CHYM FM Platinum VIP ) or through an email sent to the email address in the member's account profile. Should the member disagree with any Points adjustment or account suspension, the sole remedy will be withdrawal from the program.
96.7 CHYM FM makes no representations whatsoever regarding the value, if any, of Points earned as a result of participation. 96.7 CHYM FM is under no obligation to provide members with any particular number of Points earning opportunities or rewards.
5. Conditions
By becoming a member of 96.7 CHYM FM Platinum VIP, each member consents to the use of his/her entry, name, city of residence and/or photograph in any publicity carried out by 96.7 CHYM FM and/or its advertising agencies, without further compensation and consent to their photograph being taken for such use, without further compensation.
1. Members may be required to sign a liability release prior to acceptance of an item. Pursuant to the liability release, Member will agree to hold M2O Media, 96.7 CHYM FM, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the 96.7 CHYM FM Platinum VIP.
2. 96.7 CHYM FM, in it sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the 96.7 CHYM FM websites, or who is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the 96.7 CHYM FM Platinum VIP if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
3. 96.7 CHYM FM reserves the right to make changes in the rules of the 96.7 CHYM FM Platinum VIP. Notice of any revisions will be posted to this page, so please revisit this page from time to time to ensure that you are aware of any changes to it. You are responsible for reviewing this Policy periodically, and your continued use of the 96.7 CHYM FM Platinum VIP website(s) following any modifications to the rules will be conclusively deemed acceptance of any changes.
4. 96.7 CHYM FM reserves the right to substitute an item of equivalent or greater value should an original item awarded to or purchased by a player become unavailable. Point values associated with any award can be changed or modified at any time. All Awards offered will show quantity available and will be redeemed on a first-come, first-served basis. 96.7 CHYM FM reserves the right to limit the quantity a member can buy of any specific Award.
5. 96.7 CHYM FM reserves the right to disqualify any member from receiving a cash or prize award, where 96.7 CHYM FM, at its sole discretion, determines that the player has misrepresented or used unintended / unannounced means to accumulate Points or purchase prizes.
6. Members may be asked to supply personal information. This information will not be sold to outsiders, but the aggregate information (without identifying players as individuals) will be used for marketing purposes by 96.7 CHYM FM and its affiliates. Please see our privacy policy at www.rogers.com.
7. 96.7 CHYM FM reserves the right to discontinue, suspend or modify this Program at any time, including the termination of all opportunities to use or otherwise redeem accumulated 96.7 CHYM FM Platinum VIP. From time to time 96.7 CHYM FM may decrease or zero out the Points in all 96.7 CHYM FM Platinum VIP accounts. At those times all accounts will either start at zero Points or be decreased by an amount or percentage to be determined by 96.7 CHYM FM and all unused Points will no longer be valid. Members will be notified if and when the Points deduction will take place.
8. No purchase is necessary. 96.7 CHYM FM Platinum VIP is void where prohibited.
9. Failure to comply with 96.7 CHYM FM Platinum VIP rules may result in a player's disqualification at the sole discretion of 96.7 CHYM FM.

11. Members may unsubscribe to the 96.7 CHYM FM Platinum VIP at any time. Unsubscribing members will have 30 days to redeem their 96.7 CHYM FM Platinum VIP Points. Any unredeemed Points will be deleted at the end of the 30 day period.
12. 96.7 CHYM FM reserves the right to close a member account after 12 months of consecutive inactivity. -------------------------------------------------------------------------------- 96.7 CHYM FM Platinum V.I.P – “Your Trip A Day Station” with George & Tara No purchase necessary. 96.7 CHYM FM conducts (2) Trip A Day contests throughout the year. 1(a)”Contest Period” starts at 7:15 am on Monday, November 2, 2009 and continues until 11:59 pm on Sunday, January 3, 2010, the “Contest Closing Date” To enter, visit http://www.chymfm.com complete the sign up information in full for the CHYM-FM Platinum VIP Club, and redeem 500 Points before the Contest Closing Date. All Times are Eastern Standard Times.
NO PURCHASE NECESSARY. To enter this Contest without redeeming 500 Points, during the Contest Period, please hand print your name, address, day and evening phone numbers, email address, age, Contest name for which you are entering for a chance to win, and a hand written 100 word letter explaining why you want to win the Nov/Dec 09 CHYM FM Jet promotion and mail it to 96.7 CHYM-FM offices at 305 King Street, West, Kitchener, Ontario N2G 4E4, Attn: Nov/Dec 09 CHYM FM Jet promotion. You will receive one (1) entry into the Contest during the entry period for which your request was postmarked and received to be postmarked by the Contest Closing Date. Limit of one (1) mail-in request per postage stamped envelope per day. 1(b) One Random Draw will be made at the end of the Contest Period, during the George and Tara Morning Show from all entries received as of the contest closing date, by a representative of Rogers Broadcasting Limited (“Rogers”). 1 (c) If the selected entrant does not call back in the allotted time, we will draw another name and that person will have 10 minutes to call the designated hotline number in order to be eligible to win. We will continue this process until a winner is determined.
1(d) In the event that a selected entrant incorrectly answers the skill testing question, declines the prize, no other entrant will be selected.
1(e) Platinum VIP Club members are eligible to enter as often as desired using ballots secured through the redemption of valid Platinum VIP Points for each entry. If the identity of an entrant is disputed, the authorized account holder at the time of entry will be deemed to be the entrant. The individual assigned to the email address for the domain associated with the submitted email address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).
2. No purchase, expenditure or investment is necessary to enter this Contest. 3. There is a total of One (1) Grand Prize trip for up to FOUR (4) adults (or TWO adults and TWO children) 2 separate rooms will be available with no guarantee that they’ll be next to each other at the Allegro Puerto Plata, Dominican Republic including return economy airfare from Toronto to Dominican Republic. Prize is seven (7) nights accommodation based upon double occupancy for 2 rooms. Trip departure is April 4, 2010. Travel date may be subject to change by the Contest Sponsor at any time. Travel dates are non-transferable and have no cash value. Changes will not be permitted by the winner. Travel and health insurance, baggage insurance, as well as $149 taxes per person and transportation to and from the airports, passport and other travel documents such as visas are the responsibility of the winner. Failing to provide the required documents may result in denied boarding by the air carrier/and or entry by immigration authorities to the visiting country or re-entry into Canada. Tips, room services and other hotel charges, telephone charges, spending money and any other items not specifically mentioned as part of the Grand Prize trip are not included. Rogers is not responsible in the event the winner and/or their traveling companion are denied entry into the destination country or re-entry into Canada and any unused portion of the grand prize will be forfeit. Winner and traveling companion must travel together on the same itinerary.
4. All prizes must be accepted as awarded. Rogers reserves the right to substitute a prize of at least equal value, for whatever reason, of the advertised prize.
5. In order to win, selected entrants must first correctly answer, unaided, a time limited, mathematical skill testing question, posed by telephone at a mutually convenient time. Rogers judges' rulings are final and without appeal in all matters related to the Contest and the awarding of prizes.
6. Entrants will be required to return a signed release and acknowledgment form before being declared a winner.
7. By entering this Contest, each entrant consents to the use of his/her entry, name, and city of residence and/or photograph in any publicity carried out by Rogers and its advertising agencies, without further compensation. Winners consent to their photograph being taken by Rogers for such use, without further compensation. All entries become the property of Rogers.

9. No correspondence will be entered into except with the selected entrants. 10. Chances of winning depend on the number of eligible entries received. Rogers is unaware of how many entrants there may be. The winners may come from any geographic area, so long as they otherwise qualify to enter the Contest (see #8).
11. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Rogers. Rogers takes no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors.
12. All entries become property of Rogers who assume no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the Contest. Rogers reserve the right, in their sole discretion; to cancel or suspend the email portion of this Contest should a virus, bug or other cause beyond the reasonable control of Rogers corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Rogers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
13. Rogers is collecting personal data about entrants for the sole purpose of administering this Contest. Entrants not wishing to receive any other informational or marketing communications from the Contest Sponsor should so indicate on their entry form. Please see our Privacy Policy located at www.rogers.com for full information on the policy towards maintaining the privacy and security of user information.
14. This Contest will be run in accordance with these rules, subject to amendment by Rogers. Entrants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest.
15. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
