THE FAN CLUB

1. Participation
To participate in THE FAN Club visit http://www.fan960.com and sign up as a FAN Club member. Limit one user account per person. Once signed up as a FAN Club member you can earn FAN Points by visiting THE FAN 960 website, logging into THE FAN Club and doing any of the following:
a. Play Secret Seats, Bonus Codes, Instant Win Codes: Listen to THE FAN 960 for announcements throughout the day at various times. Secret Seats will change daily, Monday through Friday. Secret Seat numbers will not air during Play By Play on THE FAN 960. Members must enter the Secret Seat number of the day before 11:59 pm the same day it is announced. Any other Bonus Codes or instant wins will be announced on-air or posted on the website with details on how to play.
b. Play other games. At various times during the day, other FAN Club Codes, words, or names may be announced or posted on the site. These must also be entered on line before a designated time that will be posted on the site or announced on-air.
c. Listen to The FAN 960 and log on to http://www.fan960.com for dates and locations of FAN 960 events where members can pick up FAN Club Bonus Codes.
d. FAN Club FAN Points may also be earned in a variety of other ways, at the discretion of THE FAN 960. Members can tune into THE FAN 960 for details on additional ways to accumulate FAN Points, or log onto THE FAN Club at http://www.fan960.com. THE FAN 960 reserves the right to alter the ways of earning FAN Points at its discretion.
To become and remain a registered FAN Club member, you must have Internet access and a valid email account. THE FAN 960 is not responsible for a member's inability to: connect to the internet, log into THE FAN Club website, gain access to their FAN Club account or participate in any activity associated with this program, service outages or delays, computer difficulties or other technological glitches. FAN Club membership is free and no purchase is necessary.

2. Eligibility
Participation in THE FAN Club is open to all residents of the Calgary and southern Alberta within THE FAN 960 radio broadcast signal area who are 18 years of age or older.
Those specifically not eligible are full or part-time employees of THE FAN 960 or Rogers Broadcasting Ltd. (including former employees and their next of kin), other Calgary and area radio station employees and their immediate families, M2O Media, and sponsors featured in the Program.
a. Participation is expressly limited to one account per person. FAN Points are non-transferable and may not be earned in advance. All duplicate accounts or suspected duplicate accounts are subject to cancellation without notification by THE FAN 960.
b. Email addresses may not be shared between players; therefore, each account needs to have a unique, valid email address associated with it.
c. Accounts which have an excessive number of rejected emails may be automatically locked, preventing the player from accessing THE FAN Club until they contact THE FAN Club Tech Support and provide an alternate email address. Repeated problems with email delivery to a player may result in permanent suspension of the member's account.
Members are not authorized to access any other member’s account, including entering codes or redeeming THE FAN Club FAN Points for prizes or awards, even if the other member is a family member. Members need to enter codes and play the various FAN Club games and surveys themselves to legally accumulate FAN Points.
d. No machines, scripts or automated services may be used to access any part of THE FAN Club website, accumulate any FAN Points, bid on prizes and awards, or in any other way participate in this program. Over usage of THE FAN Club system resources is not permitted, and are grounds for account suspension or termination at the sole discretion of THE FAN 960.
e. THE FAN 960 is NOT responsible for members missing out on FAN Points due to, but not limited to, the following: forgotten username and/or password; problems, updates or maintenance which affects THE FAN Club at a particular time; internet, browser, server, or computer problems in general; lost codes or coupons; forgotten, incorrectly entered or misspelled codes, etc.
f. Any FAN Points redemption suspected to be an inauthentic copy, or which is made in such a fashion as to not deduct the appropriate FAN Points amounts, may be disqualified (not accepted), at the sole discretion of THE FAN 960.
g. The authorized account holder or member is defined as the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address.
h. THE FAN 960 reserves the right to disqualify any member from receiving a cash or prize award where THE FAN 960, at its sole discretion, determines that the member has violated any of these rules, made any misrepresentation in connection with this program, or used any unintended/unannounced means to accumulate or redeem FAN Club FAN Points.
i. Sharing of Secret Seat numbers, Bonus Codes, or other FAN Club FAN Points earning among members is expressly prohibited. Violations will result in the termination of all violating account(s) and/or forfeiture of all accumulated FAN Points.
j. THE FAN 960 reserves the right to use any listener feedback in any way they choose.
3. Prize Awards
Each item on the Garage Sale or Draws pages will be assigned a FAN Point value. Members may redeem accumulated FAN Club FAN Points for free prizes and awards.
a. All prizes must be picked up at The FAN 960 offices at 2723 – 37th Avenue NE, Calgary Alberta unless otherwise specified upon FAN Point redemption. Please allow two business days for your prize to be processed before picking up your item.  The FAN 960’s office hours are Monday to Friday, 8:30 am to 4:30 pm, excluding holidays.
b. When picking up your prize, you must provide a legal, valid government issued photo ID. The address on your ID must match that of your FAN Club membership. Prizes must be picked-up within 30 business days of purchase unless otherwise specified. Prizes not picked up within 30 business days from the date of purchase will be forfeited and FAN Points will not be refunded.
c. Mailing options are at the sole discretion of THE FAN 960 and will only be considered in extreme circumstances, or will be based on the prize size, weight, timeliness, and value. Member is always responsible to keep his/her FAN Club account up-to-date with current information. If THE FAN 960 deems that an individual has extreme circumstances and a prize is mailed out, THE FAN 960 is not responsible if it is lost, stolen, misdirected, or damaged. The prize will not be replaced with future prizes nor will FAN Points be refunded.
d. Prize winners are responsible for any and all expenses associated with their travel to and from THE FAN 960 offices or other any location(s) associated with claiming a prize or award.
e. FAN Club FAN Points will not be credited or refunded for any reward, item or certificate which a Member claims but does not subsequently use.
f. Member agrees to provide only true and accurate information to THE FAN Club at all times. In conjunction with claiming any item associated with THE FAN Club or spending any FAN Points for items, Member agrees to verify that all information in their FAN Club account profile is up-to-date and accurate by providing a valid driver's license or government issued photo ID that substantially matches the information in their profile.
FAN Club Award items are not transferable. Awards may not be substituted for cash or any other items or merchandise.
g. All Award claims are subject to verification by THE FAN 960 management. All decisions made by THE FAN 960 management are final.
h. Prizes and awards will be awarded and distributed at the discretion of THE FAN 960.

4. How to Redeem FAN Points / Entries to Receive Prizes
A validated FAN Club Member redeems FAN Club FAN Points by clicking on the "Submit" button for Free Stuff or for Draw entries on THE FAN Club website. In the event that another member is already in the process of redeeming that particular prize/item, the member who "first" clicked on "Submit" will receive the item/prize.
In order to receive a prize or reward, winning members must contact THE FAN 960 in accordance with instructions provided as part of this program, or provided online in connection with a specific offering, AND comply with the instructions provided by THE FAN 960 personnel for verification and deduction of FAN Points balances.
Failure to comply with the instructions may result in disqualification, at the sole discretion of THE FAN 960. Any member that has a "winning" bid, and then fails to demonstrate they have the needed FAN Points in their account following an audit, will not be entitled to receive the award or prize and, at the discretion of THE FAN 960, will have their FAN Points balance forfeited.
Member FAN Point totals are subject to adjustment, and member accounts are subject to suspension or cancellation, by THE FAN 960 for any activity which is in violation of any rules, or which is not in compliance with the intent of the program. THE FAN 960 shall be the sole determiner in cases of suspected abuse or violation of FAN Club rules, and any decision it makes relating to adjustment of FAN Points or termination of membership shall be final and binding. Members will be notified of any such adjustments through a posting in the history log (viewable in the Transactions section of My Account in THE FAN Club) or through an email sent to the email address in the member's account profile.  Should the member disagree with any FAN Points adjustment or account suspension, the decision of THE FAN is final and the remedy may involve Member withdrawal from the program.
THE FAN 960 makes no representations whatsoever regarding the value, if any, of FAN Points earned as a result of participation. THE FAN 960 is under no obligation to provide members with any particular number of FAN Points earning opportunities or rewards.

5. Conditions
a. Members may be required to sign a liability release prior to acceptance of an item.  Pursuant to the liability release, Member will agree to hold M2O Media, THE FAN 960, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in THE FAN Club.
b. THE FAN 960, in it sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of THE FAN 960 websites, or who is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify THE FAN Club if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
c. THE FAN 960 reserves the right to make changes in the rules of THE FAN Club. Notice of any revisions will be posted to this page, so please revisit this page from time to time to ensure that you are aware of any changes to it. You are responsible for reviewing this Policy periodically, and your continued use of THE FAN Club website(s) following any modifications to the rules will be conclusively deemed acceptance of any changes.
d. THE FAN 960 reserves the right to substitute an item of equivalent or greater value should an original item awarded to or purchased by a player become unavailable. FAN Point values associated with any award can be changed or modified at any time. All Awards offered will show quantity available and will be redeemed on a first-come, first-served basis. THE FAN 960 reserves the right to limit the quantity a member can buy of any specific Award.
e. THE FAN 960 reserves the right to disqualify any member from receiving a cash or prize award, where THE FAN 960, at its sole discretion, determines that the player has misrepresented or used unintended / unannounced means to accumulate FAN Points or purchase prizes.
f. Members may be asked to supply personal information. This information will not be sold to outsiders, but the aggregate information (without identifying players as individuals) will be used for marketing purposes by THE FAN 960 and its affiliates in accordance with the Privacy Policy available at www.rogers.com.
g. THE FAN 960 reserves the right to discontinue, suspend or modify this Program at any time, including the termination of all opportunities to use or otherwise redeem accumulated FAN Club FAN Points. From time to time THE FAN 960 may decrease or zero out FAN Points in all THE FAN Club accounts. At those times all accounts will either start at zero FAN Points or be decreased by an amount or percentage to be determined by THE FAN 960 and all unused FAN Points will no longer be valid. Members will be notified if and when FAN Point deduction will take place.
h. No purchase is necessary. THE FAN Club is void where prohibited.
9. Failure to comply with FAN Club rules may result in a player's disqualification at the sole discretion of THE FAN 960.
i. A written copy of THE FAN Club rules is available during regular business hours at THE FAN 960 offices or by sending a self-addressed stamped envelope to: THE FAN Club, 2723 – 37th Avenue NE, Calgary, Alberta, T1Y 5R8

CONTEST RULES
“FAN CLUB JANUARY 09 SHOWCASE RULES”
1. (a) “Contest Period” starts at 9:01am on Monday January 5th, 2009 up until 11:59 pm on Thursday January 29, 2009 the “Contest Closing Date” to enter visit www.fan960.com, and sign up as a FAN CLUB MEMBER via link and fully complete the sign up information and redeem 500 FAN CLUB Points to participate in this Contest before the Contest Closing Date.  All times are Mountain Daylight Times.

NO PURCHASE NECESSARY. To enter this Contest without redeeming 500 FAN CLUB Points, during the Contest Period, please hand print your name, address, day and evening phone numbers, email address, age, Contest name for which you are entering for a chance to win, and a hand written 100 word letter explaining which showcase you want to win and why and mail it to FAN 960 – November Showcases, 2723 37th Avenue N.E. Calgary, AB T1Y 5R8. You will receive one (1) entry into the Contest during the entry period for which your request was postmarked and received, to be postmarked by the Contest Closing Date. Limit of one (1) mail-in request per postage stamped envelope per day.

(b) One (1) lucky entrant will be randomly drawn by a Rogers Broadcasting Limited (“Rogers”) representative from all completed entries received as of the Contest Closing Date on Friday, January 30th, 2009 at approximately 8:45am at 2723 37th Avenue N.E. Calgary, AB T1Y 5R8 and he or she will receive their choice of one (1) prize package:
(i) Flames Trip to Atlanta - consisting of a trip for two (2) to Atlanta, Georgia, USA including roundtrip economy airfare between Calgary, Alberta to Atlanta, Georgia, USA and three (3) nights hotel accommodations for two (2) people, based upon double occupancy, the hotel to be decided, to be taken on March 7th, 2009, and returning on March 10th, 2009, two (2) tickets to watch the Atlanta Thrashers vs. the Calgary Flames on March 8th 2009 (having an approximate retail value of $4,000); or,
(ii) 52” Big Screen Television and Blue Ray - consists of a 52” inch big screen TV and a Blue Ray DVD player. Delivery of the television is the responsibility of the winner along with costs associated with the delivery. (Having an approximate retail value $2,500); or,
(iii) Flames Trip to Phoenix - consisting of a trip for two (2) to Phoenix, Arizona, USA including roundtrip economy airfare between Calgary, Alberta to Phoenix, Arizona, USA and three (3) nights hotel accommodations for two (2) people, based upon double occupancy, the hotel to be decided, to be taken on February 13th, 2009, and returning on February 16th, 2009, two (2) tickets to watch the Phoenix Coyotes vs. the Calgary Flames on February 14th, 2009 (having an approximate retail value of $4,000); or,
 (iv) Palm Springs - consisting of a trip for two (2) to Palm Springs, California, USA including roundtrip economy airfare between Calgary, Alberta to Palm Springs, California, USA and three (4) nights hotel accommodations for two (2) people, based upon double occupancy, the hotel to be decided, including three (3) rounds of golf, meals, rental car and green fees, trip must be taken by June 30th, 2009 (having an approximate retail value of $4,000); or,
(v)  Trip to Las Vegas- consisting of a trip for two (2) to Las Vegas, Nevada USA including roundtrip economy airfare between Calgary, Alberta to Las Vegas, Nevada, USA and three (3) nights hotel accommodations for two (2) people, based upon double occupancy, the hotel to be decided, including $500 CDN, in spending cash, two (2) tickets to a yet to be decided entertainment venue, trip must be taken by June 30th, 2009 (having an approximate retail value of $4,000); or,
(vi) Flames trip to Toronto - consisting of a trip for two (2) to Toronto, Ontario including roundtrip economy airfare between Calgary, Alberta to Toronto, Ontario and two (2) nights hotel accommodations for two (2) people, based upon double occupancy, the hotel to be decided, to be taken on March 13th, 2009, and returning on March 15th, 2009, two (2) tickets to watch the Toronto Maple Leafs vs. the Calgary Flames on March 14th, 2009 (having an approximate retail value of $4,000); or,
(vii)  Ultimate Nickelback Package – consisting of four (4) tickets to see Nickelback at the Pengrowth Saddledome on April 2nd, 2009, dinner (including drinks) for four (4), up to a maximum value of $500 any additional items ordered above this amount will be the responsibility of the winner, and his or her guests, use of a private limousine for transportation to and from the concert, a bookshelf stereo with Nickelback’s complete CD collection, and four (4) tickets to game one (1) of the Calgary Flames first playoff game (having an approximate retail value of $4,000);

(For all applicable trips:  Not included are gratuities, transfers, or any expenses not specifically listed. Black out dates may apply.  We recommend the purchase of medical, accident and baggage insurance. It is the responsibility of the prize winner and traveling companion to obtain and pay for the required identification documents (i.e. passports, visas) for their entry into the visiting country and re-entry into Canada prior to departure. Failing to provide the required documents will result in denied boarding by the air carrier/and or entry by immigration authorities to the visiting country or re-entry into Canada. Rogers Broadcasting Limited is not responsible in this respect and any unused portion of the trip prize will be forfeit. It is the prize winner’s responsibility to check with the airline for baggage restrictions.  Winner and traveling companion must travel together on the same itinerary. Where there are dates specified the trips must be taken on these dates, no other dates are available, no cash substations, the traveling companion must be over the age of 21 to participate in this prize, any items of a personal nature is the responsibility of the winner and traveling companion, due to the nature of this prize,  trips must be taken on the dates specified, no other dates will be given or substitutions allowed, Rogers is not responsible for cancellation of any events and that part of the prize will be forfeited, the traveling companions must also be over the age of 21 in order to take part in this prize).

 

(c) Selected entrant will be contacted by email or telephone as indicated on their member account/mail in entry.  If a selected entrant cannot be reached by Monday, February 3rd, 2009 or declines the prize another entrant will be chosen to replace that entrant.
(d) In the event that a selected entrant incorrectly answers the skill testing question, no other name will be drawn.
(e) Entrants can enter as many times as they wish providing they redeem 500 FAN CLUB Points for each entry. If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant.  The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder.  A selected entrant will be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.  All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).
(f)  The Grand Prize will not be released without the winner being present and adequately identified. 
2. No purchase, expenditure or investment is necessary to enter this Contest. 
3. Participants will be eligible for one (1) of the prize packages as outlined above.
4. All prizes must be accepted as awarded and may not be transferred or exchanged. Rogers reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize.
5. (a) In order to win, selected entrant must first correctly answer, unaided, a time limited, mathematical skill testing question, posed by telephone at a mutually convenient time. 
(b) Rogers judges' rulings are final and without appeal in all matters related to the Contest and the awarding of prizes.
6. Selected entrant will be required to return a signed release and acknowledgment form before being declared a winner.  The traveling companion must also be required to return a signed release and acknowledgement before being ticketed, once ticketed no changes are permitted.
7. By entering this Contest, each entrant consents to the use of his/her entry, name, address and/or photograph in any publicity carried out by Rogers Broadcasting Limited and/or its advertising agencies, without further compensation.  Winner consents to their photograph being taken by Rogers for such use, without further compensation.  All entries become the property of Rogers.
8. This Contest is open to residents of Alberta, 21 years of age or older as of the date of entry, except employees of Rogers, its respective parent and affiliate companies; representatives and agents, the Contest suppliers and those with whom they are domiciled.  This Contest is subject to all applicable federal, provincial and municipal laws and regulations.
9. No correspondence will be entered into except with the selected entrant.  10. Chances of winning depend on the number of eligible entries received.  Rogers is unaware of how many entrants there may be. The winner may come from any geographic area, so long as they otherwise qualify to enter the Contest.
11.All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules will be disqualified by Rogers.  Rogers takes no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors.
12. All entries become property of Rogers who assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the Internet or Rogers network during the Contest Period, for any problems or technical malfunction of any telephone network or lines, cell sites, microwave dish, antenna, switch, computer on-line systems, servers, access providers, computer equipment, software, failure of any communication or traffic congestion on the Rogers or other network, or any combination thereof including any injury or damage to an entrant’s or any other person’s wireless device or personal computer related to or resulting from playing or downloading or sending any material in the Contest.  Rogers reserves the right, in its sole discretion, to cancel or suspend the online or email portion of this Contest should a virus, bug or other cause beyond the reasonable control of Rogers corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any equipment or system or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Rogers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
13.  Rogers is collecting personal data about entrants for the sole purpose of administering this Contest. Entrants not wishing to receive any other informational or marketing communications from the Contest Sponsor should so indicate on their entry form.  Please see our Privacy Policy at www.rogers.com for full information on the company’s policy towards maintaining the privacy and security of user information.
14. This Contest will be run in accordance with these rules, subject to amendment by Rogers.  Entrants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest.
15. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
